A federal judge has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without lawful basis.

"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her ruling.

The situation stems from a mistaken deportation to El Salvador in March, which US authorities later admitted was an mistake. Following his return to the United States to face alien smuggling charges, he was detained in federal detention.

In her decision, the judge noted that the government does not have a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."
